These Terms and Conditions govern access to and use of the ProPacks platform, game, website, and related services operated by ProStake Inc.
1. Acceptance of terms By creating an account, accessing the service, or making a purchase, the user agrees to these Terms and Conditions.
2. Eligibility Users must be legally capable of entering into a binding agreement under applicable law. ProPacks may impose minimum age requirements or require parental or guardian consent where required.
3. Service description ProPacks is a digital esports-themed card collection and strategy game. Users may purchase fixed-price digital content containing predefined, non-randomized digital collectibles used exclusively within the game.
4. No cash value; no gambling ProPacks items, cards, XP, ranks, progression features, and cosmetics are provided solely for entertainment and gameplay purposes. They are not redeemable for money, are not withdrawable, and do not represent any right to cash, prizes, investment returns, or real-world value.
5. License Subject to compliance with these Terms and Conditions, ProPacks grants the user a limited, personal, non-exclusive, non-transferable, revocable license to access and use the service. No ownership rights in the platform or digital content are transferred to the user.
6. Accounts Users are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their account. ProPacks may suspend or terminate accounts used fraudulently, abusively, or in violation of these terms.
7. Purchases and billing All prices, billing methods, and available products are displayed at checkout. By completing a purchase, the user authorizes ProPacks and its payment processors to charge the selected payment method for the stated amount.
8. Digital items and availability ProPacks may modify, rebalance, replace, remove, or discontinue digital content, gameplay features, and service functionality at any time where reasonably necessary for maintenance, security, legal compliance, or product development. Such changes do not create a right to compensation except where required by law.
9. Prohibited conduct Users may not:
Use cheats, bots, exploits, automation, or unauthorized software.
Attempt to reverse engineer, interfere with, or disrupt the service.
Sell, transfer, or sublicense accounts or in-game items unless expressly permitted.
Use the service for unlawful, fraudulent, or abusive purposes.
Upload content that infringes third-party rights or violates applicable law.
10. User content If users submit usernames, profiles, messages, feedback, or other content, they grant ProPacks a non-exclusive, worldwide, royalty-free license to host, use, reproduce, and display that content as needed to operate and improve the service.
11. Suspension and termination ProPacks may suspend, restrict, or terminate access to the service if the user breaches these terms, creates legal or security risk, engages in fraud, or harms the platform or other users.
12. Disclaimers The service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. ProPacks does not guarantee uninterrupted availability, error-free operation, or that gameplay outcomes will meet user expectations.
13. Limitation of liability To the fullest extent permitted by law, ProPacks will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from use of the service. Where liability cannot be excluded, it will be limited to the amount paid by the user to ProPacks in the 12 months before the event giving rise to the claim.
14. Indemnity The user agrees to indemnify and hold harmless ProPacks, its affiliates, and service providers from claims arising out of the user’s misuse of the service, violation of these terms, or infringement of third-party rights, to the extent permitted by law.
15. Governing law These Terms and Conditions are governed by the laws applicable to ProStake Inc., excluding conflict-of-laws rules, unless mandatory local consumer law provides otherwise.
16. Changes to terms ProPacks may update these Terms and Conditions from time to time. Material changes will be communicated by reasonable means before they take effect where required by law.
